Appendix
Article 35 of law no. 78-17 of January 6, 1978 on data processing, data files and individual liberties, as amended by law no. 2004-801 of August 6, 2004.
Personal data may only be processed by a subcontractor, a person acting under the authority of the controller or that of the subcontractor, on the instructions of the controller.
Any person processing personal data on behalf of the controller is considered a processor within the meaning of this law.
The processor must provide sufficient guarantees to ensure the implementation of the security and confidentiality measures mentioned in article 34. This requirement does not relieve the data controller of its obligation to ensure compliance with these measures.
The contract between the processor and the controller must specify the processor's obligations with regard to data security and confidentiality, and stipulate that the processor may only act on instructions from the controller.
